2. Service Description

ConFlow offers free website building services for construction and contractor companies, as well as on-going services for website support and maintenance. Our subscription service plans begin after the website is completed and ready to launch.

3. Subscription Plans

3.1 Free Website Building: The creation of your website is completely free of charge.

3.2 Subscription Start: Your subscription plan will commence once the website is built and ready to be launched.

3.3 Payment: Subscription fees are billed monthly, starting from the launch date.

4. Ownership

4.1 Initial Ownership: The website belongs to ConFlow until you complete one full year of continuous service on one of our subscription plans.

4.2 Transfer of Ownership: After one year of continuous subscription service, ownership of the website will transfer to you.

5. Limitation of Liability

In no event shall ConFlow, its employees, officers, directors, or affiliated persons or entities, be liable to you or any other person for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profit or goodwill, for any matter arising out of or relating to ConFlow services, this agreement (or its termination), and/or its subject matter, whether such liability is asserted on the basis of contract, tort, or otherwise even if ConFlow has been advised of the possibility of such damages. ConFlow and any related businesses’ total liability (including attorney fees) for damages hereunder or any cause whatsoever relating to ConFlow services, contractor services, or any applications therein, shall be limited to $250.

6. Marketing Materials

You hereby grant ConFlow a non-exclusive, non-assignable, perpetual license to use screenshots, links, the name of the business for which the services are provided, and other information about a client’s website in its promotional or marketing materials. You permit and authorize ConFlow to use such information publicly, including, but not limited to, on the ConFlow website, on ConFlow’s social media accounts, and on other public websites and forums unless you request otherwise in writing. If for any reason you prefer that your website not be featured, you can write to support@conflow.online.

7. Client Responsibilities

You are responsible for providing accurate and complete information necessary for the creation and maintenance of your website. Any delays caused by missing or inaccurate information provided by you are not the responsibility of ConFlow.

8. Hosting and Maintenance

8.1 Hosting: ConFlow provides hosting as part of our subscription plans. We ensure your website is accessible and performs well.

8.2 Maintenance: Regular updates, backups, and security checks are included in your subscription to keep your website running smoothly and securely.

9. Support

ConFlow offers customer support to assist with any issues or questions you may have regarding your website. Support is available during our regular business hours.

10. Termination

10.1 Cancellation by Client: You may cancel your subscription at any time. However, if canceled before one year, ownership of the website remains with ConFlow.

10.2 Termination by ConFlow: We reserve the right to terminate your subscription for violations of these terms or any unlawful activities.

11. Information Accuracy and Legal Liability

11.1 Information Accuracy: ConFlow is not liable for the accuracy or legality of the content on your website.

11.2 Legal Liability: ConFlow holds no legal liability for any lawsuits brought against your business or website. You are solely responsible for the content and legal compliance of your website.

12. Modifications to Terms

ConFlow reserves the right to modify these Terms and Conditions at any time. We will notify you of any changes via email or through our website.

13. Intellectual Property

All materials, including but not limited to text, images, graphics, and code, provided by ConFlow are protected by intellectual property laws. You agree not to copy, distribute, or create derivative works from any ConFlow materials without explicit permission.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles.
